Public Offer
In accordance with Article 369 of the Civil Code of the Republic of Uzbekistan, this document constitutes a public offer to conclude a contract for the provision of services for the manufacture and delivery of products (hereinafter referred to as the "Goods") under the "BESTBURGER" trademark. Any person who accepts this offer, places an order, and complies with the established requirements using the information and materials published on the website http://bestburger.uz (hereinafter referred to as the "Website") shall be deemed to have entered into an agreement under the terms set forth herein.
1. TERMS AND DEFINITIONS
1.1. In this offer, unless the context otherwise requires, the following terms shall have the meanings ascribed to them below: 1.1.1. "Courier Service" means persons providing Goods delivery services on behalf of the Seller or its employees. 1.1.2. "Seller" means a legal entity engaged in entrepreneurial activity for the sale of Goods in accordance with the legislation of the Republic of Uzbekistan. The full name and location of the Seller are specified on the Website. 1.1.3. "Buyer" means a fully capable individual or a representative of a legal entity who has concluded an agreement with the Seller under the terms of this offer to purchase Goods for personal, family, home, or other needs not related to entrepreneurial activity. 1.1.4. "Website" means http://bestburger.uz. 1.1.5. "Phone" means +998 65 572-16-66. 1.1.6. "Goods" means the products presented on the Website. The actual appearance of the Goods may differ from the images on the Website.
1.2. Terms used in the singular shall also apply to the plural and vice versa.
2. GENERAL PROVISIONS
2.1. The Seller and the Buyer confirm that they possess the necessary rights, legal capacity, and competence to conclude and execute the contract.
2.2. The Buyer undertakes to familiarize themselves with the terms of this offer, information about the Goods, the privacy policy, and the terms of the user agreement available on the Website.
2.3. The Seller reserves the right to amend this offer, and the Buyer undertakes to monitor such changes independently. 2.4. By placing an order, the Buyer confirms their agreement with the terms of this offer.
2.5. The contract is deemed concluded at the moment the Buyer clicks the order confirmation button or receives a notification that the order is ready.
2.6. The validity period of the offer is unlimited unless otherwise specified on the Website.
3. SUBJECT OF THE CONTRACT
3.1. The Seller provides Goods at the prices specified on the Website and delivers them via the Courier Service. The Buyer pays for and accepts the Goods in accordance with the terms of this offer.
3.2. Ownership of the Goods transfers to the Buyer at the moment of receipt.
4. CUSTOMER INFORMATION
4.1. The Seller has the right to send the Buyer notifications about promotions and promotional materials, subject to obtaining the Buyer's consent.
4.2. The Buyer may unsubscribe from receiving promotional notifications at any time and resubscribe.
4.3. The Seller has the right to conduct marketing research, calls, and analysis of provided services, provided that the Buyer has given consent to the processing of their data.
4.4. The Seller has the right to send automated service notifications related to the execution of the order, which cannot be disabled by the Buyer.
5. ORDERING
5.1. An order can be placed by Phone or by filling out the electronic form on the Website.
5.2. The Buyer undertakes to provide accurate data necessary for the execution of the order.
5.3. In case of any questions regarding the Goods prior to ordering, the Buyer must contact the Seller by Phone.
5.4. An order can only be placed for Goods that are currently in stock with the Seller. 5.5. The Seller has the right to record telephone conversations to fulfill the terms of the offer.
6. DELIVERY OF GOODS
6.1. Delivery is carried out to the address specified by the Buyer.
6.2. The base delivery cost is 10,000 UZS and covers a distance of up to 3 km. If this distance is exceeded, each subsequent kilometer is paid separately at the rate of 2,000 UZS/km. — For remote areas, the delivery cost is determined by the operator.
6.3. Delivery time: 45 minutes from the moment the order is accepted. In exceptional cases (weather conditions, traffic jams), the period may be increased up to 90 minutes.
7. PAYMENT FOR GOODS
7.1. Prices for Goods are indicated in Uzbek Soums (UZS) and can be paid in cash or by bank card.
7.2. When paying in cash, the Buyer must receive a receipt.
8. RETURN AND EXCHANGE OF GOODS
8.1. Returns of Goods of proper quality are not allowed.
8.2. In case of defects discovered in the Goods, the Buyer has the right to demand a replacement within 1 hour from the moment of receipt.
9. FORCE MAJEURE
9.1. The parties shall be released from liability for failure to perform obligations in the event of force majeure circumstances.
10. LIABILITY OF THE PARTIES
10.1. All disputes shall be resolved through negotiations, or through the court if a mutual agreement cannot be reached.
11. FINAL PROVISIONS
11.1. This offer is an official document of the Seller. All appendices to the offer are an integral part thereof. 11.2. The invalidity of individual clauses of the offer does not entail the invalidity of its other provisions.
